This book is a collection of secondary essays on America's most important philosophic thinkers—statesmen, judges, writers, educators, and activists—from the colonial period to the present. Each essay is a comprehensive introduction to the thought of a noted American on the fundamental meaning of the American regime.

Carl Schmitt was the most famous and controversial defender of political theology in the twentieth century. But in his best-known work, _The Concept of the Political_, issued in 1927, 1932, and 1933, political considerations led him to conceal the dependence of his political theory on his faith in divine revelation. In 1932 Leo Strauss published a critical review of _Concept _that initiated an extremely subtle exchange between Schmitt and Strauss regarding Schmitt’s critique of liberalism. Although Schmitt never answered Strauss publicly, (...) in the third edition of his book he changed a number of passages in response to Strauss’s criticisms. Now, in this elegant translation by J. Harvey Lomax, Heinrich Meier shows us what the remarkable dialogue between Schmitt and Strauss reveals about the development of these two seminal thinkers. Meier contends that their exchange only ostensibly revolves around liberalism. This long overdue English translation of Karl Löwith's magisterial study is a major event in Nietzsche scholarship in the Anglo-American intellectual world. Its initial publication was extraordinary in itself—a dissident interpretation, written by a Jew, appearing in National Socialist Germany in 1935. Since then, Löwith's book has continued to gain recognition as one of the key texts in the German Nietzsche reception, as well as a remarkable effort to reclaim the philosopher's work from political misappropriation. For Löwith, the centerpiece of (...) Nietzsche's thought is the doctrine of eternal recurrence, a notion which Löwith, unlike Heidegger, deems incompatible with the will to power. His careful examination of Nietzsche's cosmological theory of the infinite repetition of a finite number of states of the world suggests the paradoxical consequences this theory implies for human freedom. How is it possible to will the eternal recurrence of each moment of one's life, if both this decision and the states of affairs governed by it appear to be predestined? Löwith's book, one of the most important, if seldom acknowledged, sources for recent Anglophone Nietzsche studies, remains a central text for all concerned with understanding the philosopher's work. PrécisThe administration of Pre-Mortem Interventions (PMIs) to preserve the opportunity to donate, to assess the eligibility to donate, or to optimize the outcomes of donation and transplantation are controversial as they offer no direct medical benefit and include at least the possibility of harm to the still-living patient. In this article, we describe the legal analysis surrounding consent to PMIs, drawing on existing legal commentary and identifying key legal problems. We provide an overview of the approaches in several jurisdictions that (...) have chosen to explicitly address PMIs within codified law. We then provide, as an example, a detailed exploration of how PMIs are likely to be addressed in one jurisdiction where general medical consent law applies because there is no specific legislation addressing PMIs — the province of Ontario in Canada. This paper questions the dogmatic stance of the domestic courts toward mandatory orders for treatment, arguing that this has the potential to subjugate patients' interests to clinical discretion, and proposing a via media to accommodate the legitimate concerns of all parties.

CATHOLIC PERSPECTIVES AND CONTEMPORARY MEDICAL MORALS A Catholic perspective on medical morals antedates the current world wide interest in medical and biomedical ethics by many centuries[5]. Discussions about the moral status of the fetus, abortion, contraception, and sterilization can be found in the writings of the Fathers and Doctors of the Church. Teachings on various aspects of medical morals were scattered throughout the penitential books of the early medieval church and later in more formal treatises when moral theology became recog (...) nized as a distinct discipline. Still later, medical morality was incorpor ated into the many pastoral works on medicine. Finally, in the contemporary period, works that strictly focus on medical ethics are produced by Catholic moral theologians who have special interests in matters medical. Moreover, this long tradition of teaching has been put into practice in the medical moral directives governing the operation of hospitals under Catholic sponsorship. Catholic hospitals were monitored by Ethics Committees long before such committees were recommended by the New Jersey Court in the Karen Ann Quinlan case or by the President's Commission in 1983 ([8, 9]). Underlying the Catholic moral tradition was the use of the casuistic method, which since the 17th and 18th centuries was employed by Catholic moralists to study and resolve concrete clinical ethical dilem mas. The history of casuistry is of renewed interest today when the case method has become so widely used in the current revival of interest in medical ethics[ll]. (shrink)

I examine recent arguments based on functionalism that claim to show that Bohm's theory fails to solve the measurement problem, or if it does so, it is only because it reduces to a form of the many-worlds theory. We hypothesised that belief in conspiracy theories would be predicted by the general tendency to attribute agency and intentionality where it is unlikely to exist. We further hypothesised that this tendency would explain the relationship between education level and belief in conspiracy theories, where lower levels of education have been found to be associated with higher conspiracy belief. In Study 1 participants were more likely to agree with a range of conspiracy theories if they also tended to attribute intentionality and (...) agency to inanimate objects. As predicted, this relationship accounted for the link between education level and belief in conspiracy theories. We replicated this finding in Study 2, whilst taking into account beliefs in paranormal phenomena. These results suggest that education may undermine the reasoning processes and assumptions that are reflected in conspiracy belief. (shrink)

Although workplace bullying is common and has universally harmful effects on employees’ outcomes, little is known about workplace bullies. To address this gap in knowledge, we draw from the tenets of social exchange and displaced aggression theories in order to develop and test a model of workplace bullying that incorporates the effects of employees’ individual differences, perceptions of their work environments, and perceptions of supervisory treatment on their tendencies to bully coworkers. The results of mediated moderation analyses that examine responses (...) from two samples of working adults support our hypotheses. Specifically, we find evidence of an indirect relationship between entitlement and coworker bullying through perceptions of abusive supervision that is stronger for employees who report lower levels of felt accountability than employees who report higher levels of felt accountability. This study makes important theoretical and practical contributions to abusive supervision research, bullying research, and organizational efforts to promote ethical work environments devoid of interpersonal mistreatment by providing novel insight into how employees’ entitlement and felt accountability combine to influence their tendencies to perceive themselves as victims of abusive supervision and culprits of coworker bullying. Philosophical theories of emotions, and to an extent some theories of scientific psychology, represent attempts to capture the essence of emotions basically as they are conceived in common sense psychology. Although there are problems, the success of explanations of our behavior in terms of believes, desires and emotions creates a presumption that, at some level of abstraction, they reflect important elements in our psychological nature. It is incumbent on a theory of emotions to provide an account of two salient facts (...) about emotions as conceived in common sense psychology. As intentional states, emotions have representational and rational properties: emotions represent states of affairs; and they are rationally related to other mental representations, figure in rational explanations of behavior, and are open to rational assessment. Emotions also have a close relationship to a range of non-intentional phenomena: in typical cases, emotions involve physiological changes, usually associated with the activation of the autonomic nervous system, which are proprioceptively experienced; and they often involve behavioral tendencies, as well. If the density matrix is treated as an objective description of individual systems, it may become possible to attribute the same objective significance to statistical mechanical properties, such as entropy or temperature, as to properties such as mass or energy. It is shown that the de Broglie--Bohm interpretation of quantum theory can be consistently applied to density matrices as a description of individual systems. The resultant trajectories are examined for the case of the delayed choice interferometer, for which Bell [Int. (...) J. Quantum chem. 155--159, (1980)] appears to suggest that such an interpretation is not possible. Bell’s argument is shown to be based upon a different understanding of the density matrix to that proposed here. (shrink)

We present two studies investigating the impact of causal perceptions and the moral emotions of anger, shame, and guilt on the justification of deviant workplace behavior. Study 1 tests our conceptual framework using a sample of undergraduate business students; Study 2 examines a population of practicing physicians. Results varied significantly between the two samples, suggesting that individual and contextual factors play an important role in shaping the perceptual and emotional processes by which individuals form reactions to undesirable affective workplace events. The present study provides evidence that the activation strength produced by emotional stimuli must pass a threshold level in order to be consciously perceived, contrary to the assumption of continuous quality of representation. An analysis of receiver operating characteristics for attentional blink performance was used to distinguish between two models of emotion perception by inspecting two different ROC’s shapes. Across all conditions, the results showed that performance in the attentional blink task was better described by the two-limbs ROC predicted by (...) the Krantz threshold model than by the curvilinear ROC implied by the signal-detection theory. The formulae advanced by Popper to calculate the degree of corroboration C of a scientific hypothesis are unsatisfactory in that the probability values required in the computation are often not available. An attempt is made to define a quantitative measure B* in the place of C in which only countable empirical values would be used. This condition is fulfilled in two basic formulae and eq. ), which could be applied to calculate the degree of corroboration. When m successful falsifications of (...) the hypothesis h appear after a sequence of n unsuccessful ones, the pragmatic degree of corroboration B* results from the difference between B and the analogue value of the falsification F* and eq. ). In the event that the hypothesis can be "rescued" through a correction, increased experimental effort must be made with the revision. This would be taken into account through the correction equation ). When the hypothesis cannot be corrected, however, it can no longer exceed the value of 1-F*, even after numerous verification experiments. In the process of deciding whether a hypothesis is "adequately" verified or falsified, a lower threshold ${\rm B}_{{\rm u}}$ und Bₒ must be selected. These values have to be chosen on an intuitive subjective basis. The same applies to the strength of unsuccessful falsifications . This evaluation is expressed by a multiplicative constant a̱ ) or an additive constant kₐ in eq. . Despite the subjectivity of the values a̱, kₐ necessary for the calculation of B*, and of the values ${\rm B}_{{\rm u}}$ , Bₒ for the decision to discontiue the examination of the hypothesis, I feel that amongst the scientists within a particular field of research, a consensus for these values should be possible. Through a quantitative determination of B* the procedure for testing a hypothesis, considered to be a closed loop process, becomes clearer. To estimate the values of B* could not only have an influence upon the decisions of the respective researchers or research groups examining a hypothesis, but also be of assistance in decisions regarding research grants when financial resources are limited. Herodotus tells us in book vii, ch. 220, that the Pythian priestess gave the Spartans a warning couched in hexameters, of which the second line begins ἢ μγα στυ ρικυδς. To this text the admirable commentary of How and Wells takes exception in the following note: ‘The synizesis στυ ρικυδς is intolerable. Read δμ' ρικυδς, στυ being a gloss, H. Richards, Cl. Rev. xix. 345.’ Doubtless this union of vowels is harder than that of υω in ρινων or in γενων (...) and δυωδεκμηνον, accepted by Christ in his edition of Pindar . Let us grant that from the point of view of elegance it is even intolerable; the question still remains, should the line be altered? (shrink)

‘Saepe stilum vertas’, says Horace; and he had excellent company in his friend Virgil, who wrote the Aeneid at the rate of only about 900 lines a year, and spent hours in licking his verses into shape. It would have been instructive to sit at the elbow of these two poets, to see what they altered and what they rejected. It is clear, e.g., that there were certain caesural arrangements which Virgil deliberately affected and others which he as deliberately avoided. (...) But what of the care taken by these and other classical authors in arranging sounds in relation to mood or idea? This present incomplete essay is written frankly with scepticism in regard to dogmatic comments on certain particular points. It has been perilously easy to frame legislation on the basis of a predilection bolstered up by one or two instances. Even in the field of syntax we have seen generalizations on too narrow a foundation. An editor of Andocides enunciates ‘a very important principle of the language, which is rigidly observed by the best writers; viz., that, when a participle and a verb of different government are referred to the same object, the case of that object depends on the participle and not at all on the verb… Shilleto's remarks on this point must be excused, as evidently written hastily.’ But a casual cast of the net brings up about a score of violations of this principle from Homer to Menander. Where does the editor propose to draw the line between the respectable and the declassé Greek writers? Aristophanes, though cited in support, is actually flagrantly lawless in the matter; and with him must go not only Homer and Hyperides but Sophocles, Euripides, Menander, Xenophon, Lysias, and Plato, leaving among the élite, as cited by this editor, only Thucydides, Antiphon, and Aeschines; and one is entitled to doubt even their rigid observance of the law until they have actually been brought to court. In problems of rhythm, also, one has to be careful to use evidence as against preconception. When an editor hacks and fits the dactylics of Ennius so as to eradicate all feet beginning with two short syllables, it is as impious as recarving a statue by Daedalus because it does not conform to the canon of Polyclitus; and one may be forgiven if now and then one interprets the editor's corr. in his apparatus criticus not as correxi but as corrupi. On Virgil's statement that in honour of Bacchus ‘Ausonii … coloni versibus incomptis ludunt’, Servius remarks: ‘id est, carminibus Saturnio metro compositis, quod ad rhythmum solum vulgares componere consuerunt….’Obviously Servius is drawing a distinction between the Saturnian and other metres, as well as between the ordinary man and the man of letters. The unlettered compose their verses in the Saturnian metre, which is founded on rhythmus alone; the literary circles write theirs on some other basis.

When Demosthenes brought Aeschines to trial on a charge of malfeasance as an ambassador, he made what seems now the astonishing declaration in connection with Aeschines' acting of the part of Creon in Sophocles' Antigone: ⋯στε γ⋯ρ δ⋯που το⋯θ' ὅτι ⋯ν ἅπασι τοῖς δρ⋯μασι τοῖς τραγικοῖς ⋯ξα⋯ρετ⋯ν ⋯στιν ὥσπερ γ⋯ρας τοῖς τριταγωνισ ταῖς τὺ τοὺς τυρ⋯ννους κα⋯ τοὺς τ⋯ σκ⋯πτρ' ἔχοντας εἰσι⋯ναι. Until the last generation this was taken at face value as indicating that of the three actors presenting a (...) tragedy the third was regularly assigned the part of royalty. But that the title rôle in such plays as Sophocles' Oedipus Tyrannus or an important character such as Creon in the Antigone should have been entrusted to the third ranking actor is incredible. ‘A foolish consistency is the hobgoblin’ not only ‘of little minds,’ but of some classically trained minds as well. And it is surprising to see how this has caused certain unevennesses in ancient authors to be trued up. Aristophanes, for example, we are toldby a late venerable scholar, never permits a change of meter in a single speech directed to the same person; and to get rid of the two deviations from this rule, the framer of it cut down the (...) seemingly good trochaic tetrameters in the Peace to iambic trimeters, and then put line 555 before line 553 and took the three lines 555, 553, 554 from Trygaeus and assigned them to the coryphaeus. It is conceivable that if we possessed the thirty-three lost comedies of Aristophanes the editor might have had more and harder surgery on his hands. (shrink)
